About you

You are passionate about safeguarding the dignity and rights of consumers experiencing mental illness. You might have lived experience yourself, or you might be close to someone with lived experience. You will understand how the public health system works and be committed to ensuring that all consumers experiencing mental illness receive the best possible mental health treatment and care with the least possible restriction to their freedom or interference with their rights.

Importantly, you will be committed to a person-centred approach to treatment and care and will understand and be willing to apply the principle of the dignity of risk. You will understand the provisions of the Mental Health Act 2014 (WA) and be committed to ensuring that involuntary mental health treatment strictly complies with the letter and the spirit of the law.

About us

The Mental Health Tribunal Western Australia is an independent statutory tribunal established under the Mental Health Act 2014 (WA). The Tribunal's primary role is to safeguard the rights of involuntary patients receiving psychiatric treatment without informed consent in Western Australia. The Tribunal reviews every involuntary treatment order in Western Australia shortly after it is made, and then every three months thereafter. The Tribunal also determines a range of other applications, including applications to administer electroconvulsive therapy and psychosurgery.

The positions

The Mental Health Tribunal Western Australia is seeking expressions of interest to fill positions as Legal Members, Psychiatrist Members and Community Members.

Members of the Tribunal hold statutory office and are appointed by the Governor on the recommendation of the Minister for Mental Health for terms of up to five years, and on the terms and conditions of appointment determined by the Minister. Members are not employees within the meaning of the Public Sector Management Act 1994 (WA).

Members may be appointed on a part-time or sessional basis, depending on the Tribunal’s operational needs at the date of appointment.  Part-time Members work fixed days every week and have paid leave entitlements.  Sessional Members work on a casual basis as needed and are paid a daily rate for each day they sit.  For sessional members there is no access to paid leave entitlements or guarantee of work. Applicants found suitable but not recommended for appointment may be considered for vacancies arising in the next 18 months.
